1. Actimerce Consultancy Ltd does not offer any guarantees as to improved business performance or sales as a result of any consultancy or training. Monies paid are non-refundable and acknowledgement of these conditions.

2. Actimerce Consultancy Ltd accepts no liability as a consequence of negative change, loss, penalization, or damage to Amazon listings, eBay listings, website, business or 3rd party websites as a result of their training, consultation services and offsite services in any capacity. All recommendations dispensed are in good faith and to be taken as opinion only.

3. Client accepts responsibility for balance paid in full by the agreed date, and of accurate bank transfer – in the unlikely event funds transferred to wrong account, the client and associated companies will honour payment to Actimerce Consultancy Ltd.

4. Deposits paid in advance are only refundable should both parties mutually wish to terminate or if Actimerce Consultancy Ltd cannot honour the consultation and an alternative arrangement cannot be agreed.

5. The Parties shall keep confidential, and not disclose to any third party, each of the provisions of this Agreement and all business strategy, plans, discoveries, marketing information, and all other confidential information of either Party, except: (i) if and to the extent the information is already a matter of public knowledge; (ii) if and to the extent a Party acquired the information totally apart from the other Party; (iii) such disclosures as may be necessary.

6. All information and recommendations are dispensed in good faith and the client assumes responsibility for meeting the policies and guidelines of all platforms on which clients operate (e.g. Google, eBay, Amazon).

7. Actimerce Consultancy Ltd will not be responsibility for accidental damage to property or equipment.
